1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of SynContext ("we," "us," or "our"), including the website at syncontext.dev, the dashboard, the API, and the MCP server (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
SynContext is a Model Context Protocol (MCP) server that provides shared memory and context synchronization across AI assistants such as Claude, ChatGPT, and other MCP-compatible clients. The Service includes project management, context storage with full-text search, decision logging, version history, data export, and optional GitHub integration.
The Service is under active development. We may add, modify, or remove features at any time. We will make reasonable efforts to notify users of material changes.
3. Account Registration
- You must provide a valid email address and create a password of at least 8 characters.
- You must verify your email address within 48 hours to maintain API access.
- You are responsible for maintaining the security of your account credentials, including your password and API key.
- You must not share your API key publicly or with unauthorized parties.
- One account per person. Creating multiple free accounts to circumvent quotas is prohibited.
- You must be at least 13 years of age to use the Service.
- You are responsible for all activity that occurs under your account.
4. Subscription Plans and Payments
4.1 Plans
SynContext offers three subscription tiers:
- Free ($0/month) — 3 projects, 100 context entries, 50 decisions, 30 API requests per minute.
- Pro ($12/month) — 50 projects, 5,000 context entries, 2,000 decisions, 120 API requests per minute. Includes semantic search, webhooks, audit log, and GitHub read access.
- Team ($29/month) — Unlimited projects, entries, and decisions, 300 API requests per minute. Includes all Pro features plus GitHub write access (Pull Requests) and priority support.
4.2 Billing
- Paid subscriptions are billed monthly through Stripe.
- SynContext does not store your credit card information. All payment data is handled by Stripe.
- Applicable taxes are calculated and collected by Stripe based on your jurisdiction.
4.3 Cancellation and Downgrades
- You may cancel your subscription at any time through the Stripe billing portal accessible from your dashboard.
- Upon cancellation, you retain access to paid features until the end of your current billing period.
- At the end of the billing period, your account is downgraded to the Free tier. Data exceeding Free tier quotas is preserved but you will not be able to create new items beyond the limits.
4.4 Refunds
Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, contact us at [email protected] within 14 days of the charge.
4.5 Price Changes
We reserve the right to change subscription prices. We will notify existing paid subscribers by email at least 30 days before any price increase takes effect. Price changes do not apply to the current billing period.
5. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws.
- Attempt to access data belonging to other users or bypass tenant isolation.
- Abuse the Service through automated spam, excessive API calls beyond your rate limit, or denial-of-service attacks.
- Reverse engineer, decompile, or scrape the Service.
- Share your API key publicly (e.g., in public repositories, blog posts, or forums).
- Create multiple free accounts to circumvent tier quotas or rate limits.
- Store highly sensitive regulated data (credit card numbers, Social Security numbers, health records) without your own additional encryption layer.
- Use the Service to distribute malware or conduct phishing activities.
- Interfere with or disrupt the integrity or performance of the Service.
We reserve the right to suspend or terminate accounts that violate this policy.
6. Intellectual Property
6.1 Your Content
You retain full ownership of all content you create or store through SynContext, including context entries, decisions, projects, and any data stored via the API or MCP tools.
By using the Service, you grant SynContext a limited, non-exclusive license to store, encrypt, index, and serve your content solely for the purpose of operating the Service. This license terminates when you delete your content or account.
Content generated by AI assistants and stored through SynContext belongs to the user who stored it.
6.2 SynContext Property
The SynContext name, logo, website design, application code, and documentation are the property of SynContext. These Terms do not grant you any rights to use our branding or intellectual property.
7. Data and Privacy
Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.
- You can export your data at any time using the dashboard or the
hub_export_projectMCP tool. - You can delete individual projects, context entries, or your entire account at any time. Deletion is permanent.
- User content is encrypted at rest using Fernet symmetric encryption.
8. API and MCP Usage
- API access is subject to rate limits based on your subscription tier: Free (30 requests/minute), Pro (120 requests/minute), Team (300 requests/minute).
- Authentication endpoint rate limits apply to all users: 5 attempts per minute per IP address.
- Your API key is a secret credential. Treat it like a password. If compromised, regenerate it immediately from the dashboard.
- SynContext may revoke API access or suspend accounts if abuse is detected.
- SynContext is not responsible for actions that AI clients (Claude, ChatGPT, or others) take using the data retrieved from or stored in the Service.
9. Third-Party Integrations
- GitHub integration is optional and user-initiated. You choose which repositories to grant access to and can disconnect at any time.
- Pull Requests created by AI assistants through SynContext are opened as proposals. They always require human review and approval before merging. SynContext never pushes directly to your default branch.
- SynContext is not responsible for changes made to your repositories through the GitHub integration. You are responsible for reviewing all Pull Requests before merging.
- Your GitHub Personal Access Token is encrypted at rest and used solely to make API calls on your behalf.
10. Service Availability
- The Service is provided on an "as-is" and "as-available" basis.
- We do not guarantee any specific uptime percentage or service level agreement (SLA).
- We perform maintenance as needed and will attempt to provide advance notice when possible.
- We may modify, suspend, or discontinue features of the Service with reasonable notice. We will not remove features that are core to a paid tier without providing at least 30 days notice to affected subscribers.
11. Termination
11.1 By You
You may terminate your account at any time by deleting it through the dashboard or by contacting [email protected]. Upon deletion, all your data is permanently removed.
11.2 By Us
We may suspend or terminate your account if you violate these Terms, including the Acceptable Use Policy. In cases of severe or repeated violations, termination may be immediate. For other violations, we will make reasonable efforts to notify you and provide an opportunity to correct the issue.
11.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Your data will be deleted within a reasonable period. Sections 6 (Intellectual Property), 12 (Limitation of Liability), 13 (Disclaimer of Warranties), and 14 (Governing Law) survive termination.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- SynContext shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
- SynContext's total liability for any claim arising from or related to the Service shall not exceed the total amount you paid to SynContext in the 12 months preceding the claim.
- SynContext is not liable for data loss, although we take reasonable precautions to protect your data including encryption and managed database hosting.
- SynContext is not liable for any actions taken by AI clients (Claude, ChatGPT, or others) using data from the Service.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of search results, AI-generated content, or any other output of the Service.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days. If the dispute cannot be resolved informally, any legal action shall be brought in the state or federal courts located in New Jersey.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify registered users by email at least 30 days before the changes take effect. The "Last updated" date at the top of this page indicates when these Terms were last revised.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may cancel your account before they take effect.
